La nueva legislación riojana sobre defensa y protección del menor

Abstract

The Law 1/2006, of the 28th of February, for the Protection of Minors in La Rioja and its further reglamentary development in 2007 establishes a new legal frame for these issues in the Autonomous Community of La Rioja (CAR). The foundations of this new regulation about minors are based on four ideas: universal or transverse scope, which is equivalent to the integral protection of minors; effective and real regulatory efficacy; protection of the minor, although considering also the rights of parents, tutors or guardians; and lastly, a detailed description of all the procedures to safeguard all concerned parties' guarantees, specifying terms and objective criteria clearly, and the assumption of information duties. Moreover, in the case of adoption, a simplification of the procedure to be followed by applicants is included.
