La imposibilidad sobrevenida liberatoria: concepto y consecuencias indemnizatorias

The aim of this research is to provide a thorough study on the supervening impossibility, in the version to be liberated from the obligation, taking into consideration its doctrinal and jurisprudential analysis. This is intended to review the classic problems posed by this figure of conceptual differentiation and risk sharing, at the same time that poses a reflection on new issues which have appeared in recent years, as a result of being alleged this impossibility in situations of non-compliance arising from the economic crisis. Special mention should be given, due to its specific interest, to the study on the compensatory consequences of this figure. That is, the approach about the possible existence of discharge supervening impossibility and compensation for damages.Downloads
