From God’s judgment to human judgement: an approach to the problem of «truth» in the law

The law is a regulatory order based on the value of Justice. But does this approach to the law imply that the search for truth is the main aim of the work of legal practitioners? Some recent decisions suggest that this may not be the main task of those who apply the law. Nevertheless, analysis of the history of the law of evidence, of the methods of proving facts, shows that, in one way or another, the desire to uncover the truth of what really occurred has always existed. Paradoxically, these methods of seeking legal truth are highly deceptive. The philosophy of law, therefore, stresses the need for the rational justification of legal decisions.Downloads
