Some Notes On The New Organic Law On The Right Of Defence

Abstract

Article 24 of the Spanish Constitution (EC) relating to effective judicial protection and its multiple aspects has been reinforced thanks to the publication on 14 November 2024 in the Official State Gazette of Organic Law 5/2024, of 11 November, on the Right to Defence, which will come into force on 4 December of 2024. The purpose of the new regulation, which is of an organic nature due to the subject matter it develops, is to provide greater value and extol the right to defence as an element of protection and safeguard for the defendant when facing and defending their interests before the courts and tribunals under legal assistance and procedural representation in the cases required by the legal system, all in a context in which citizens must assume the main role and protagonist in the field of Justice.
