The Social Protection System for Dependent Persons in France

This study addresses the origin, development and evolution of the French system of social protection for dependent el elderly persons until the present. The study includes the reforms approved by the important 2015 Act. The French system was designed outside the Social Security System, and developed in the field of social assistance. In this regard, are analyzed the legal characteristics of the Long Term Care benefit (the APA), with special attention to the conditions for entitlement to the benefit and other main features of the APA. Then, the article analyzes the procedural nature of the right to LTC benefits and describes the processes that lead to the implementation of the Individual Plan of Care (in home). Finally, are examined the challenges and the main issues addressed by the 2015 reform, with special regard to the legal status of caregivers.
