Abstract

As in the other nearest countries, Courts have qualified the legal nature of work in platform through the analysis of the work conditions. In this field, the Supreme Court sentence, on September 25th 2020, has almost closed the debate, when it declared the work nature of the riders’ relationships in platform. Later, a reinforced presumption of work on these relations has been included into Workers Statute by Real Decreto-Ley 9/2021. Nevertheless, neither every work in platform is similar, neither every service is a delivery one, nor the labor protection is the unique solution. Thought it is always necessary to rule an adapted protection to the real situation of digital workers.
